Environmental permits, new obligations for businesses - Monitoring and auditing

The Ministry of Environment has issued for public consultation amendments to the law "On Environmental Permits", setting stricter standards for pollution control and monitoring of industrial activities.

According to the accompanying report, the draft law aims to move from a model based primarily on pollution control, towards a preventive and integrated approach, where industrial operators will be required to implement the best available techniques, continuously monitor the impact of their activity and periodically report the results to state authorities.

One of the main innovations is the obligation to create an Environmental Management System for installations that are issued with an environmental permit. This system will have to include concrete objectives for reducing pollution, more efficient use of energy and natural resources, as well as measures for minimizing waste. For the first time, operators will also have to draft transformation plans, with objectives for reducing greenhouse gas emissions by 2050, defining the investments and financial resources necessary to achieve them.

The changes are also expected to bring additional costs for businesses, especially for category A and B installations. The report explains that operators will need to invest in monitoring systems, periodic audits, environmental reporting, preparation of baseline reports and implementation of best available techniques.

On the other hand, state institutions will need to invest in improving the electronic environmental permitting system and creating a public database.
