More rights for online consumers - Changes to the e-commerce law imminent

Blocking a website, automatically redirecting to another version, or imposing different payment terms solely due to the customer's nationality or place of residence is expected to be prohibited by law.

The government has submitted for public consultation amendments to the law "On Electronic Commerce", which aim to prevent so-called unjustified geo-blocking. According to the draft law, merchants will not be able to limit customers' access to their websites or applications, nor redirect them to another version without their express consent. It is also prohibited to impose different conditions for purchasing goods, receiving electronic services or making payments, when this treatment is related only to the customer's citizenship, residence, bank account or country where the card was issued.

However, businesses will not be forced to offer deliveries or services in every country. The law aims only to prohibit unjustified discrimination in areas where the trader already operates or offers services. Exceptions are foreseen in cases where the restriction is required by law, as well as for some services related to copyright. The implementation of these rules will be supervised by the authorities responsible for consumer protection, while citizens will be able to seek help from alternative dispute resolution points.

The amendments aim to align Albanian legislation with European Union rules and are related to the negotiation process for Chapter 10, “Digital Transformation and Media.” According to the report, the draft law does not foresee additional costs for the state budget, as implementation will be mainly entrusted to existing structures.
