Whoever receives payments from abroad will pay obligations - Electronic information system is established. New mechanisms for debt collection

The development of electronic commerce and the increased use of cross-border payments have brought new challenges to tax administration, especially in terms of VAT control and collection. The lack of structured information on these payments makes it difficult to identify entities that exercise economic activity without fulfilling tax obligations, creating space for tax evasion. For this reason, the Ministry of Finance has submitted for consultation the draft law “On reporting cross-border payments and the creation of an electronic information system on these payments”, which aims to address these issues by creating a legal framework that enables the collection, administration and reporting of information on cross-border payments, in accordance with European Union standards and the CESOP system.
The implementation of this draft law is expected to increase transparency in cross-border transactions; improve the identification of entities that evade VAT obligations; strengthen the tax administration's capacities for risk analysis, and increase international cooperation in the tax field.
The draft law brings financial effects to the state budget of around 8 million euros, as it foresees the creation of the Electronic Information System on Cross-Border Payments.
In parallel, the draft law "On mutual assistance in the collection of obligations arising from taxes, customs duties and other obligations" has been submitted for public consultation, which aims to create a complete, unified and effective legal framework for cooperation between the competent authorities of the Republic of Albania and the counterpart authorities of the European Union member states in the field of mutual assistance for the collection of obligations in the tax and customs fields.
This draft law establishes mutual assistance mechanisms that enable Albanian and EU Member State authorities to cooperate in identifying debtors and their assets, notifying administrative acts and taking measures to secure and collect outstanding obligations. In this way, obligations cannot be avoided because the debtor or his assets are located outside the territory of the state where the obligation arose, thereby strengthening the effectiveness of public revenue collection and cross-border cooperation with European Union Member States.
The implementation of this legal framework significantly increases the effectiveness of the recovery of tax and customs obligations with a cross-border element, reducing the possibilities for their avoidance through the transfer of assets abroad and contributing to the protection of the public revenues of the Republic of Albania.
